Clarification Text on the Protection of Personal Data (in accordance with Law No. 6698)
As HMS ÖZCEYLANLAR Hidrolik Makina Sanayi Tic. A.Ş., acting as the data controller within the meaning of the Law on the Protection of Personal Data No. 6698 (“PDPL”), we attach importance to the security of your personal data processed by us. Therefore, we would like to inform you about the processing of your personal data.

DEFINITIONS
In this clarification text:
“Personal Data”: Any information relating to an identified or identifiable real person,
“Law on the Protection of Personal Data (“PDPL”)”: Law No. 6698 on the Protection of Personal Data, which entered into force on 7 April 2016,
“Data Processor”: The real or legal person who processes personal data on behalf of the data controller based on its authority,
“Data Controller”: The real or legal person who determines the purposes and means of processing personal data and who is responsible for establishing and managing the personal data filing system.

PURPOSE AND LEGAL BASIS FOR PROCESSING YOUR PERSONAL DATA
Your personal data are processed in compliance with Law No. 6698 and its secondary regulations within the framework of the following purposes and legal bases:
• The processing will be in accordance with the law and the rules of honesty,
• Accurate and when necessary up‑to‑date,
• For specified, explicit and legitimate purposes,
• Related, limited and proportionate to the purposes for which they are processed,
• Stored in accordance with the rules of retention as required by the relevant legislation or for the period necessary for the purposes for which they are processed.
The personal data obtained such as “Name‑Surname, Signature, TIN (Turkish Personal Identification Number), E‑Mail, Address, Phone, Identity Information” are processed for the purpose of establishing the contract pursuant to Article 5/2‑c of the PDPL.
And personal data such as “Name‑Surname, Phone, E‑mail” are processed for the purpose of informing you about our company’s campaigns, with your consent, pursuant to the Law on Regulation of Electronic Commerce No. 6563 and Article 5/2‑a of the PDPL.

TRANSFER OF YOUR PERSONAL DATA
The personal data you provide to us may be transferred within the scope of the purposes described above and in accordance with this clarification text and with your explicit consent to Notaries, Suppliers, banks or financial institutions, Project partners, Customers, Public or Private Bodies authorized by law, our Associates and Subsidiaries in Türkiye and/or abroad (and/or third‑party business partners required for performance of the relevant business) or to the public or private institutions and organizations legally authorized, in cases where transfer is required or requested in compliance with Articles 8 and 9 of the PDPL.

METHODS OF COLLECTION OF YOUR PERSONAL DATA
HMS ÖZCEYLANLAR Hidrolik Makina Sanayi Tic. A.Ş. collects your personal data such as “Name‑Surname, Signature, TIN, E‑Mail, Address, Phone, Payment Information for Sale Price” in relation to the purposes set out in this Clarification Text, at the moment when you express your intention to purchase. In addition, your personal data may also be collected in other ways when you contact HMS ÖZCEYLANLAR Hidrolik Makina Sanayi Tic. A.Ş. and disclose them.

STORAGE OF YOUR PERSONAL DATA
Your personal data, such as “Name‑Surname, Signature, TIN, E‑Mail, Address, Phone, Payment Information for Sale Price” processed for the purpose of establishing and performing the contract and personal data processed with your consent for the purpose of informing you about our company’s campaigns, will be retained for the periods of statute of limitations under the PDPL’s Articles 5/2‑c and 5/2‑a. Personal data such as “Identity Information” which are processed based on your explicit consent will be processed and retained as long as you have not withdrawn your consent. You may withdraw your explicit consent at any time.

YOUR RIGHTS REGARDING YOUR PERSONAL DATA
Pursuant to Article 11 of the PDPL, everyone has the following rights in relation to his or her personal data:
a) To learn whether his or her personal data are processed or not,
b) If his or her personal data have been processed, to request information about that,
c) To learn the purpose of processing of personal data and whether they are used accordingly,
ç) To know the third parties inside or outside the country to whom personal data are transferred,
d) To request correction of personal data if they are incomplete or incorrectly processed,
e) To request deletion or destruction of personal data within the framework of the conditions in Article 7 of the PDPL,
f) To request notification to third parties to whom personal data have been transferred,
g) To object to emergence of a result against the person by means of exclusively automated systems whereby personal data are processed,
ğ) To claim compensation for damage arising from unlawful processing of personal data.

As a data subject, you have these statutory rights regarding your personal data and you may apply to HMS ÖZCEYLANLAR Hidrolik Makina Sanayi Tic. A.Ş. with your requests conforming to the “Communiqué on Procedures and Principles of Application to the Data Controller”. HMS ÖZCEYLANLAR Hidrolik Makina Sanayi Tic. A.Ş. will finalize your request free of charge within at most 30 (thirty) days according to its nature. However, if an additional cost is required for the process, HMS ÖZCEYLANLAR Hidrolik Makina Sanayi Tic. A.Ş. may request the fee specified in the tariff determined by the Personal Data Protection Board.
You must submit your application clearly and comprehensively, attaching documents verifying your identity and address, in written form with wet signature, in person, by mail or via notary to:
